Findablebiz Terms of Service

1. Acceptance of Terms

By accessing and using the services provided by Findablebiz (“we,” “us,” or “our”), you (“Client,” “you,” or “your”) agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.

2. Services

Findablebiz provides a range of digital marketing services, including but not limited to search engine optimization (SEO), social media marketing, content creation, online advertising, and listing management. The scope of services to be provided will be outlined in a separate agreement between Findablebiz and the Client.

3. Client Responsibilities

  • Provision of Information: You agree to provide accurate and complete information necessary for us to perform the services. Any delays or failures in service resulting from your failure to provide such information shall not be the responsibility of Findablebiz.
  • Approval of Content: You are responsible for reviewing and approving all content, including but not limited to text, images, and videos, before publication. Once approved, Findablebiz is not liable for any errors or omissions in the content.

4. Payment Terms

  • Fees: Fees for services will be outlined in the separate agreement. Payment is due as specified in the invoice, and late payments may result in additional charges or suspension of services.
  • Refunds: All fees are non-refundable unless otherwise stated in the separate agreement.

5. Intellectual Property

  • Ownership: All content, materials, and intellectual property created by Findablebiz in the course of providing services shall remain the property of Findablebiz until full payment has been received. Upon full payment, ownership of the content will transfer to the Client.
  • Use of Client Materials: You grant Findablebiz a non-exclusive, royalty-free license to use your trademarks, logos, and other intellectual property solely for the purpose of providing the agreed-upon services.

6. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary or confidential information disclosed during the course of the service agreement. This obligation shall survive the termination of the agreement.

7. Termination

  • Termination by Client: You may terminate the service agreement at any time with 30 days’ written notice. Any fees paid in advance will not be refunded.
  • Termination by Findablebiz: We may terminate the service agreement immediately if you breach any of these Terms. In the event of termination, you will be responsible for paying any outstanding fees.

8. Limitation of Liability

To the fullest extent permitted by law, Findablebiz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of our services. Our total liability under these Terms shall not exceed the amount paid by you for the services.

9. Indemnification

You agree to indemnify, defend, and hold harmless Findablebiz and its affiliates, employees, and agents from any claims, liabilities, damages, and expenses arising out of or related to your use of the services, violation of these Terms, or infringement of any intellectual property or other rights of any person or entity.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of [Insert State], USA, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in [Insert City, State], in accordance with the rules of the American Arbitration Association.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
